Managerial and Confidential Positions (Exclusions) and Union Certification

The Compensation and Labour Relations (CLR) Branch develops and implements directives and guidelines on managerial or confidential exclusions, application of union dues, and certification of bargaining agents. It provides advice to departments and agencies of the Core Public Administration, named in Schedule I and Schedule IV of the Financial Administration Act, in managing their exclusion files and in administering union dues in accordance with collective agreements.

On behalf of those departments and agencies, the Branch is responsible for negotiating managerial or confidential exclusions with the bargaining agents. Where agreement cannot be reached, the Branch represents the Treasury Board, which is the employer, before the Public Service Labour Relations Board. It also responds, on behalf of the employer, to certification issues such as applications for certification or decertification of bargaining agents and changes in bargaining unit configuration.
